Nigel Doughty threatens fans with legal action??

Nottingham Forest Chairman Nigel Doughty has attempted to prevent fans from using nigeldoughty.co.uk as a base for their "Bringing and end to the spin" campaign. The project aims to counter 5 years of spin generated by the club (in the form of Chief Executive Mark Arthur and Mr Doughty himself) and in so doing provide a fair account of Nigel Doughty's tenure as Chairman.

Just 36 hours after registering the domain (which already has around 300 members), the site received a formal letter from the chairman's solicitors stating the following;

Dear Sir ,

WWW.NIGELDOUGHTY.CO.UK

We are solicitors and we have been asked by Nigel Doughty to contact you with regard to the above website. Our client hopes this matter can be dealt with on an amicable basis.

Our client fully understands, and personally feels the disappointment felt by Nottingham Forest fans in not reaching the play-off final. He also acknowledges that fans may wish to make their views known on the internet and in no way does he want to seek to restrict their freedom of speech.

However, our client cannot allow his name ( or the Nottingham Forest name ) to be used in the domain name of any website which he does not own or control, without his consent.

You may be aware that the law protects the names of individuals from being used , without their consent , and requires such domain names to be renamed, transferred to the individual concerned or closed down. You may be interested to view www.nominet.org.uk which provides evidence to support this.

In the circumstances we must insist that the domain name www.nigeldoughty.co.uk is renamed or closed down immediately.

Our client does not wish to take legal proceedings against you but regrets that he will do so if you fail to rename or to close down the domain name by 4.30 pm on Thursday 24 May 2007.

In the end, site management decided to move the site, despite Mr Doughty having no legal right to the previous site URL. The primary reason behind this decision was to stop talking about legal action and focus on the campaign in hand.
